Welcome to BudgetBadger! These Terms of Service ("Terms") govern your access to and use of BudgetBadger's personal finance management service (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account Terms

To use BudgetBadger, you must:

  • Be at least 18 years old
  • Provide a valid email address
  • Create a secure password
  • Provide accurate and complete information

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not share your account with others or use another person's account. Each account is intended for use by a single individual or household.

2. Service Description

BudgetBadger is a personal finance management service that helps you track income, expenses, budgets, and financial goals. The Service provides:

  • Automated transaction categorization
  • Budget creation and tracking
  • Financial reporting and insights
  • Account aggregation through third-party services

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be error-free.

3. Plaid Integration

BudgetBadger uses Plaid Inc. ("Plaid") to connect your financial accounts. By using the Service to connect your accounts, you acknowledge and agree to the following:

  • Read-Only Access: BudgetBadger uses Plaid to access your financial account information in read-only mode. We cannot and will not move money from your accounts, initiate transfers, or make any changes to your accounts.
  • Data Sharing: When you connect your accounts through Plaid, Plaid will collect, process, and share your financial data with BudgetBadger in accordance with Plaid's End User Privacy Policy.
  • Plaid's Services: Your use of Plaid's services is subject to Plaid's terms and conditions. We are not responsible for Plaid's services or any issues that may arise from your use of Plaid.
  • Account Information: Plaid may access and collect information from your financial accounts, including but not limited to account balances, transaction history, account details, and other information necessary to provide the Service.

You may disconnect your accounts from Plaid at any time through your account settings or by contacting us. Disconnecting your accounts may limit or prevent your use of certain features of the Service.

4. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes
  • Provide accurate and complete information
  • Maintain the security of your account
  • Notify us immediately of any unauthorized access
  • Not attempt to gain unauthorized access to the Service
  • Not use the Service to violate any laws or regulations

You are solely responsible for all financial decisions you make based on information provided by the Service. BudgetBadger does not provide financial, investment, or tax advice.

5. Intellectual Property

The Service, including all content, features, functionality, and technology, is owned by BudgetBadger and protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, BudgetBadger and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from your use of the Service.

In no event shall BudgetBadger's total liability to you for all claims exceed the amount you paid to BudgetBadger in the twelve (12) months prior to the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any information provided by the Service.

8. Arbitration Agreement

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), except as modified by this agreement.

Waiver of Class Action: You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Location: The arbitration shall be conducted in the state where you reside, or another mutually agreed location.

Exceptions: This arbitration agreement does not prevent you from bringing claims in small claims court, or from seeking injunctive relief in a court of competent jurisdiction.

9. Termination

You may terminate your account at any time by contacting us or through your account settings. We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

Upon termination, your right to use the Service will immediately cease. We may delete your account and data in accordance with our Privacy Policy and data retention policies.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

Beta Test Disclaimers

Note: BudgetBadger is currently in beta testing. The following additional terms apply during the beta period:

  • The Service may contain bugs, errors, or incomplete features
  • Features may change or be removed without notice
  • The Service may be unavailable at times for maintenance
  • Data may be lost due to bugs or issues
  • We may reset or clear test data during the beta period

By using the Service during the beta period, you acknowledge that you are testing an early version of the app and helping us improve it. We appreciate your patience and feedback!
